Enforcement Regulations of the Plant Variety Protection and Seed Act
(Ordinance of the Ministry of Agriculture, Forestry and Fisheries No.83 of December 3, 1998)

The Ordinance for revision of the entirety of Enforcement Regulations of the Plant Variety Protection and Seed Act (Ordinance of the Ministry of Agriculture, Forestry and Fisheries No.17 of 1978) is established as follows on the basis of Article 2, paragraph 6, Article 4, paragraph 2, Article 5, paragraph 1 and paragraph 2, Article 6, paragraph 1, Article 7, paragraph 2 and paragraph 3, Article 11, paragraph 1, Article 18, paragraph 3, Article 20, paragraph 2, item 1, Article 21, paragraph 3, Article 22, paragraph 2, Article 38, paragraph 1, Article 46, Article 47, paragraph 1, Article 49, paragraph 1, and Article 50, paragraph 1, item 6 of the Plant Variety Protection and Seed Act (Act No.83 of 1998) and for implementing the Act.
(Class of Agricultural, Forestry or Aquatic Plants)
Article 1. The classes specified by Ordinance of the Ministry of Agriculture, Forestry and Fisheries under Article 2, paragraph 7 of the Plant Variety Protection and Seed Act (Hereinafter, referred to as the “Act”) shall be as listed in the left side of Annexed table 1, and the agricultural, forestry, or aquatic plants belonging to respective classes shall be as listed in the intermediate column.
(Genus or Species of Perennial Plants)
Article 2. The genus or species of the agricultural, forestry, or aquatic plants specified by an Ordinance of the Ministry of Agriculture, Forestry and Fisheries under Article 4, paragraph 2 of the Act shall be woody plants.
(Terminology, etc., of Documents)
Article 3. The documents relating to an application for variety registration shall, excluding documents prescribed under the next paragraph and paragraph 3, be written in Japanese.
However, roman letters may be used with regards to the name and domicile or residence of the applicant, the breeder of the applied variety, and the name of the applied variety.
2. The documents relating to an application for variety registration shall, with regards to the scientific names of the genus or species of the agricultural, forestry, or aquatic plants, be written in roman letters.
3. Regarding a power of attorney and other documents, written in a foreign language, translations thereof shall be attached.
(Procedures of Application for Variety Registration)
Article 4. A person filing an application for variety registration with regards to a variety in which seeds or spawns are the propagating materials shall submit the seeds or strains of the variety when filing the application.
(Matters, etc., to be Stated in the Application)
Article 5. Regarding the genus or species of the agricultural, forestry, or aquatic plants prescribed in Article 5, paragraph 1, item 2 of the Act, the scientific names and Japanese names of the species or genus which are listed in Annexed Table 2 and to which the applied varieties belong shall be described. However, where the species or genus to which the applied varieties belong is not listed in the Table, the scientific name and Japanese name which can specify the species or genus to which it belongs shall be stated.
2. The matters specified by Ordinance of the Ministry of Agriculture, Forestry and Fisheries in Article 5, paragraph 1, item 5 of the Act shall be as follows.
(1) Where the applied variety is a variety for which an application equivalent to an application for variety registration was filed in a foreign State, the name of the State in which the application was filed and the name of the variety
(2) When the applicant claims a right of priority under the provision of Article 11, paragraph 1 of the Act, the statement to that effect, the name of the contracting State (in the case of an Intergovernmental Organization, its name) in which the application was first filed and the filing date of the application, or the name of the State in which, among the specified State applications, the first application (where the applicant belongs to the specified State, the application filed in the specified State. Hereinafter, referred to as “the first specified State application”) was filed, and the filing date of the application filed in the specified State
(3) Where the propagating material or the harvested material of the appied variety was transferred in the course of trade prior to the filing date of the application (excluding the case where a transfer was made for the purpose of experiment or research, or where a transfer was made against the will of the breeder), the date of the first transfer in Japan, the date of the first transfer in a foreign country, and the country in which the transfer was made
(4) Listing of exhibits and attached documents
(5) When requesting the application of the provisions of Article 13, paragraph 1 of the Act on Promotion of Utilization of Organic Resources Originated from Agriculture, Forestry or Fisheries as Materials for Biomass Fuels (Act No.45 of 2008), the statement to that effect and the certificate number of Article 10 of the Enforcement Regulations of the Act on Promotion of Utilization of Organic Resources Originated from Agriculture, Forestry or Fisheries as Materials for Biomass Fuels (Ordinance of the Ministry of Agriculture, Forestry and Fisheries, Ministry of Economy, Trade and Industry, Ministry of the Environment No. 1 of 2008)
(6) When requesting the application of the provisions of Article 12, paragraph 1 of the Act on the Promotion of Utilization of New Applications of Rice (Act No.25 of 2009), the statement to that effect and the certificate number of Article 14 of the Enforcement Regulations of the Act on the Promotion of Utilization of New Applications of Rice (Ordinance of the Ministry of Agriculture, Forestry and Fisheries No.41 of 2009)
(7) When requesting the application of the provisions of Article 17, paragraph 1 of the Act on the Creation of New Businesses by Agriculture, Forestry, or Fishery Persons Utilizing Local Resources and Promotion of Utilization of Local Agricultural and Marine Products (Act No.67 of 2010), the statement to that effect and the certificate number of Article 16 of the Enforcement Regulations of the Act on the Creation of New Businesses by Agriculture, Forestry, or Fishery Persons Utilizing Local Resources and Promotion of Utilization of Local Agricultural and Marine Products (Ordinance of the Ministry of Agriculture, Forestry, and Fisheries No.7 of 2011)
(8) When requesting the application of the provisions of Article 42, paragraph 2 of the Act of Special Measures Concerning Reconstruction and Revitalization of Fukushima (Act No. 25 of 2012), the statement to that effect and the certificate number of Article 4 of the Enforcement Regulations of the Act of Special Measures Concerning Reconstruction and Revitalization of Fukushima related to the Ministry of Agriculture, Forestry and Fisheries (Ordinance of Ministry of Agriculture, Forestry and Fisheries No. 33 of 2012)
 3. The request shall be created in accordance with Annexed Format No.1.
(Documents to be Attached to the Request)
Article 6. The following documents shall be attached to the request of Article 5, paragraph 1. However, if the document of item 4 cannot be attached when filing the appplication, it may be submitted within three months from the day following the filing of the application.
(1) Where all of some of the applicants are persons other than the breeder of the applied variety, a document certifying that they are the successors of the breeder of the applied variety
(2) Where the application is filed by a representative, a document certifying his/her authority
(3) When the applicant is a foreign national, a document certifying his/her nationality, or any of the following documents
(A) Where the applicant has domicile or residence in Japan (in the case of a corporation, business office), a document certifying the same
(B) Where the applicant has domicile or residence in a contracting party, etc., other than Japan or a member state (in the case of a corporation, business office), a document certifying the same
(C) Where the state to which the applicant belongs (excluding a contracting party and a member state) provides Japanese nationals with the protection on the breeding of varieties under the same conditions as for its own nationals, or which provides Japanese nationals with the protection, provided that Japan allows nationals of that state to enjoy a breeder's right and other rights related to a breeder's right, a document certifying the same and a document certifying that the state provides protection in relation to the breeding of the variety according to the application
(4) When the applicant claims priority under the provision of Article 11, paragraph 1 of the Act, a document certifying the fact that the first application was filed in the contracting party or in the specified state
(Matters to be Stated in the Description, etc)
Article 7. The matters specified by Ordinance of the Ministry of Agriculture, Forestry and Fisheries under Article 5, paragraph 2 of the Act are as follows.
(1) The characteristics of the plant of the applied variety and the characteristics which are clearly distinguished thereby from other plants
(2) Methods for breeding and propagating the applied variety
(3) In the case of a variety which does not have seeds or spawn as the propagating material, the conditions of the protection of the plant of the applied variety
(4) The main usage of the applied variety and points to consider on cultivation thereof
2. The description shall be prespared in accordance with Annex Format 2.
3. The photograph under Article 5 of the Act shall show the characteristics of the plant of the applied variety (excluding the case when a photograph cannot be taken) which make the plant clearly distinguishable from other plants.
(Amount, etc., of Application Fee)
Article 8. The amount specified by the Ordinance of the Ministry of Agriculture, Forestry and Fisheries under Article 6, paragraph 1 of the Act shall be 47200 yen.
2. The application fee shall be paid with revenue stamps attached to the request. However, where the application for variety registration is filed using an electronic data processing system prescribed in Article 3, paragraph 1 of the Act on the Utilization of Information and Communications Technology in Administrative Procedure, etc. (Act No. 151 of 2002. Hereinafter, referred to as “Information and Communications Technology Utilization Act”), under the provisions of the same paragraph, the fees shall be paid in cash based on the payment information acquired through the application for variety registration.
(Notification of Change of Name of the Applicant)
Article 9. The notifications of Article 7, paragraph 2 and paragraph 3 of the Act shall be made by submitting written notifications prepared in accordance with Appended Format 3 and Appended Format 4, respectively to the Minister of Agriculture, Forestry and Fisheries.
2. The notification of Article 7, paragraph 2 of the Act shall be made jointly by all of the applicants prior to the change of the name of the applicant and a person to whom the name of the applicant is to be changed.
3. Where there is an agreement on the portion of shares of the breeder’s right to be granted upon variety registration, where there is an agreement prescribed in Article 23, paragraph 2 of the Act, or where there is a contract under the proviso of Article 256, paragraph 1 of the Act as applied mutatis mutandis pursuant to Article 264 of the Civil Code, a statement to that effect shall be stated in the written notification of paragraph 1.
4. Documents certifying that the person to whom the name of the applicant is to be changed under paragraph 2 or the general successor of Article 7, paragraph 3 of the Act is the successor of the applicant shall be attached to the written notification of paragraph 1.
(Special Provisions for Submission of Materials Concerning the Application which Claimed Priority Right)
Article 10. The applicant who claimed the priority right under the provisions of Article 11, paragraph 1 of the Act shall, where requested to submit materials concerning the application which claimed the priority right under the provisions of Article 15, paragraph 1 of the Act, submit the materials within three years from the day folloiwng the filing date of the application filed in a contracting party or a specified state. However, this shall not apply to cases when the first application in the contracting party or the specified state has been rejected, or the applicant has withdrawn or abandoned the first application in the contracting party or the specified state, or when the Minister of Agriculture, Forestry and Fisheries has designated a day after the day on which the three years elapse.
(Withdrawal, etc., of Application for Variety Registration)
Article 11. The withdrawal of the application for variety registration shall be prepared in accordance with Appended Format 5, and the abandonment of the application for variety registration shall be prepared in accordance with Appended Format 6.
(Implementation Method, etc., of the Growing tests of the Applied Variety)
Article 11-bis. The growing tests of Article 15, paragraph 2 of the Act shall inspect the following matters and shall be conducted by a method in which a suitable control variety is selected, experimental plots of the applied variety and the control variety are provided, and the varieties are compared.
(1) The characteristics of the plants of the applied variety and the control variety
(2) The requirements listed in the items of Article 3, paragraph 1 of the Act concerning the applied variety
2. When interferences occur in the implementation of the growing tests of Article 15, paragraph 2 of the Act due to weather-related disasters, the occurrence of pests, or other circumstances, the Incorporated administrative agency National Center for Seeds and Seedlings (Hereinafter, referred to as “NCSS”) shall immediately notify the Minister of Agriculture, Forestry, and Fisheries of the same.
3. The NCSS shall, when having performed the growing tests of Article 15, paragraph 2 of the Act (including the case when growing tests have been requested to relevant administrative organs, educational institutions or other persons who are considered appropriate under the provisions of Article 15, paragraph 5 of the Act), without delay, report the results to the Minister of Agriculture, Forestry and Fisheries in accordance with Appended Format 6-bis.
(Format of the Argument)
Article 12. The argument of Article 18, paragraph 2 of the Act shall be prepared in accordance with Appended Format 7.
(Matters to be Publicly Notified Concerning Variety Registration)
Article 13. The matters specified by an Ordinance of the Ministry of Agriculture, Forestry and Fisheries of Article 18, paragraph 3 of the Act are as follows.
(1) The registration number and date of variety registration
(2) The genus or species of the agricultural, forestry, or aquatic plant to which the registered variety belongs
(3) The denomination of the registered variety
(4) Summary of the characteristics of the registered variety
(5) The term of the breeder’s right
(6) The name and domicile or residence of the person obtaining variety registration
(7) Name of the breeder of the registered variety
(8) Date of publication of application
(Issuance of Certificate of Variety Registration)
Article 14. The Minister of Agriculture, Forestry, and Fisheries shall, when a variety registration has been made, issue a certificate of variety registration, together with a document stating the characteristics of the registered variety to the holder of the breeder’s right.
2. The certificate of variety registration of the preceding paragraph shall be prepared in accordance with Appended Format 8.
(Methods for Breeding an Essentially-Derived Variety)
Article 15. The methods specified by the Ordinance of the Ministry of Agriculture, Forestry and Fisheries under Article 20, paragraph 2, item 1 of the Act are as follows.
(1) Selection of a mutant
(2) Backcrossing
(3) Transformation by genetic engineering
(4) Cell fusion (limited to asymmetric fusion)
(Plants which Undergo Vegetative Propagation and for which Effect of the Breeder’s Right extends to Private Propagation by Farmer)
Article 16. The plants designated by the Ordinance of the Ministry of Agriculture, Forestry and Fisheries as being propagated vegetatively under Article 21, paragraph 3 of the Act shall be those belonging to the genus or species listed in Annexed Table 3.
(Genus or Species of Similar Agricultural, Forestry, or Aquatic Plants)
Article 17. The genus or species of agricultural, forestry, or aquatic plants specified by the Ordinance of the Ministry of Agriculture, Forestry and Fisheries under Article 22 paragraph 2 of the Act shall be the genus or species of other agricultural, forestry, or aquatic plants to which the registered variety belongs, but in the case when the genus or species of the agricultural, forestry, or aquatic plants to which the registered variety belongs belong to the agricultural, forestry, or aquatic plants listed in Annexed Table 4, shall be the genus or species of the other agricultural, forestry, or aquatic plants which belong to the same denomination search class as the agricultural, forestry, or aquatic plants.
(Written Arbitration Request)
Article 18. The request for arbitration of Article 28, paragraph 2 of the Act shall be made by submitting a written request in accordance with Appended Format 9 to the Minister of Agriculture, Forestry, and Fisheries.
(Amount of Registration Fees)
Article 19. The amount specified by the Ordinance of the Ministry of Agriculture, Forestry, and Fisheries under Article 45, paragraph 1 of the Act shall be those listed in the right-hand column of the following table corresponding to the relevant period in the left-hand column of the table.

2. The registration fees (including the registration surcharge of Article 45, paragraph 8 of the Act) shall be paid by attaching revenue stamps to the written payment of the variety registration fee in accordance with Appended Format 10. However, where a written payment of the variety registration fee is submitted using the electronic data processing system under the same paragraph in accordance with the provison of Article 3, paragraph 1 of the Information and Communications Technology Utilization Act, the fees shall be paid in cash based on the payment information obtained by the submission of the written payment of variety registration fee.
3. When seeking the application of the provisions of Article 13, paragraph 2 of the Act on Promotion of Utilization of Organic Resources Originated from Agriculture, Forestry, or Fisheries as Materials for Biomass Fuels, the written payment of the variety registration fee of the preceding paragraph shall include a statement to that effect and state the certificate number of Article 10 of the Ordinance for the Enforcement of the Act on Promotion of Utilization of Organic Resources Originated from Agriculture, Forestry, or Fisheries as Materials for Biomass Fuels.
4. When seeking the application of the provisions of Article 12, paragraph 2 of the Act on the Promotion of Utilization of New Applications of Rice, the written payment of the variety registration fee of paragraph 2 shall include a statement to that effect and the certificate number of Article 14 of the Enforcement Regulations of the Act on the Promotion of Utilization of New Applications of Rice.
5. When seeking the application of the provisions of Article 17, paragraph 2 of the Act on the Creation of New Businesses by Agriculture, Forestry, or Fishery Persons Utilizing Local Resopurces and the Promotion of Utilization of Local Agricultural and Marine Products, the written payment of the variety registration fee of paragraph 2 shall include a statement to that effect and state the certificate number of Article 16 of the Enforcement Regulations of the Act on the Creation of New Businesses by Agriculture, Forestry, or Fishery Persons Utilizing Local Resources and Promotion of Utilization of Local Agricultural and Marine Products.
6.  When seeking the application of the provisions of Article 42, paragraph 3 of the Act of Special Measures Concerning Reconstruction and Revitalization of Fukushima (Act No. 25 of 2012), the written payment of the variety registration fee of paragraph 2 shall include a statement to that effect and state the certificate number of Article 4 of the Enforcement Regulations of the Act of Special Measures Concerning Reconstruction and Revitalization of Fukushima related to the Ministry of Agriculture, Forestry and Fisheries.
(Method for Implementing Growing Tests of the Registered Variety)
Article 19-bis. The provisions of Article 11-bis shall apply mutatis mutandis to the growing tests of Article 47, paragraph 2 of the Act. In this case, “the applied variety” in paragraph 1 of the same Article shall read “registered variety”, “Article 15, paragraph 5 of the Act” in paragraph 3 of the same Article shall read “Article 15, paragraph 3 of the Act as applied mutatis mutandis to Article 47, paragraph 3”, and “Appended Format 6-bis” shall read “Appended Format 10-bis”.
(Procedures for Request of Certificate, etc)
Article 20. A person requesting the issuance of the certificate, a transcript or extract of the Registry of Plant Varieties, or an inspection or copy of the application, under Article 53, paragraph 1 of the Act shall submit a request stating the following matters to the Minister of Agriculture, Forestry and Fisheries.
(1) In the case of an applied variety, the number of the application for variety registration and the name of the applied variety
(2) In the case of a registered variety, the number of the variety registration and the name of the registered variety
(3) The name and domicile or residence of the person making the request
(4) The requested items

Article 21. The amounts specified by the Ordinance of the Ministry of Agriculture, Forestry, and Fisheries under Article 54, paragraph 1 of the Act are as shown in the following Table.

2. The fees shall be paid by revenue stamps attached to the request. However, where the request of the items of Article 53, paragraph 1 of the Act is made using an electronic data processing system prescribed in Article 3, paragraph 1 of the Act on Utilization of Information and Communications Technology, under paragraph 1, the fees shall be paid in cash based on the payment information acquired through the request.
(Indication of Registered Variety)
Article 21-bis. The indication of a registered variety under Article 55 of the Act shall include either of the following items.
(1) The inscription “registered variety”
(2) The inscription of “variety registration” and its number of variety registration
(Notification by Seed Dealers)
Article 22. The notification under Article 58, paragraph 1 of the Act shall be made by submitting a written notification in accordance with Appended Format 21 to the Minister of Agriculture, Forestry and Fisheries.
2. The seed dealers specified by the Ordinance of the Ministry of Agriculture, Forestry and Fisheries in the proviso of Article 58, paragraph 1 of the Act shall be the prefectures and persons who commercially sell the designated seeds solely to persons other than seed dealers.
3. The matter specified by the Ordinance of the Ministry of Agriculture, Forestry and Fisheries under Article 58, paragraph 1, item 3 of the Act shall be a business office address.
(Indicated Items of Designated Seeds)
Article 23. The germination percentage of Article 59, paragraph 1, item 4 of the Act shall be indicated as follows.
(1) When indicating the date of production of Article 59, paragraph 1, item 4 of the Act, the indication shall be done in accordance with the provision of the same paragraph, or, the germination percentage of item 4 shall be indicated as “As of date, Germination Percentage X% or more” with the lowest percentage on the date on which a voucher was attached.
(2) When the time limit of validity of Article 59, paragraph 1, item 4 of the Act is indicated, and, when the indication is done in accordance with the provision of the same paragraph, or when the germination percentage of the same item is indicated with the lowest percentage on the date on which a voucher was attached, the indication shall be done as “As of date, Germination Percentage X% or more”.
(3) When the time limit of validity of Article 59, paragraph 1, item 4 of the Act is indicated, and, when the germination percentage of the same item is indicated with the germination percentage to be guaranteed until the time limit of validity, the indication shall be done as “Germination Percentage X% or more”.
2. The germination percentage of seeds for homes and gardens (the seeds refer to those sold mainly for homes and gardens), designated by the Minister of Agriculture, Forestry and Fisheries, as prescribed in Article 59, paragraph 1, item 4 of the Act may, notwithstanding the provisions of the preceding paragraph, be indicated by the method specified by the Minister of Agriculture, Forestry, and Fisheries.
3. The matters specified by the Ordinance of the Ministry of Agriculture, Forestry, and Fisheries under Article 59, paragraph 1, item 6 of the Act are as follows.
(1) In the case of seeds of agricultural, forestry, or aquatic plants for use in foods and feed (excluding fruit trees. Hereinafter, referred to as the “agricultural, forestry or aquatic plants for food”), for which agricultural chemicals (the agricultural chemicals listed in the items of the Ministry Ordinance for Specifying Agricultural Chemicals Specified by the Ordinance of the Ministry of Agriculture, Forestry, and Fisheries, and the Ordinance of the Ministry of the Environment under Article 12, paragraph 1 of the Agricultural Chemicals Regulation Act (Oridinace of the Ministry of Agriculture, Forestry, and Fisheries, and the Ministry of the Environment No. 4 of 2000). The same shall apply hereafter.) were used, a statement to that effect and the type of the active ingredients contained in the agricultural chemicals used and the frequency of use of the agricultural chemicals (which refers to the frequency in which the agricultural chemicals comprising the active ingredients were used in the growth period specified in Article 7, paragraph 2, item 4 of the Enforcement Regulations of the Agricultural Chemicals Regulation Act (Ordinance of the Ministry of Agriculture and Forestry No. 21 of 1951) (where the total frequency of use under item 5 of the same paragraph is described on the container or package of the agricultural chemicals, for each class of the period of use or mode of use, the frequency of use for each class))
(2) In the case of seeds of agricultural, forestry, or aquatic plants other than the agricultural, forestry or aquatic plants for food, wherein the seeds were subjected to control of pests by agricultural chemicals, a statement to that effect and the type of the active ingredients contained in the agricultural chemicals used
(3) With regards to the spawn, the date of production and the presence or absence of harmful fungi specified by the Minister of Agriculture, Forestry, and Fisheries
(Certificate for Identification)
Article 24. The certificate of Article 62, paragraph 2 of the Act shall be prepared in accordance with Appended Format 12.
2.The certificate of Article 63, paragraph 4 of the Act shall be prepared in accordance with Appended Format 13.
(Classes of Collection of Designated Seeds)
Article 25. The classes on the basis of which the Minister of Agriculture, Forestry and Fisheries under the provision of Article 63, paragraph 1 of the Act makes the NCSS or the Incorporated administrative agency National Livestock Breeding Center collect the designated seeds from sead dealers in an amount necessary for inspection, are shown in the following Table.

(Report of Results of Inspection)
Article 26. The results of the inspection under Article 63, paragraph 3 of the Act shall be reported to the Minister of Agriculture, Forestry and Fisheries, without delay, at the conclusion of the inspection by sybmitting a report prepared in accordance with Appended Format 14.
(Report)
Article 27. The report under the provisions of Article 6, paragraph 4 of the Enforcement Order of the Plant Variety Protection and Seed Act (Cabinet Order No. 368 of 1998) shall be made without delay, by submitting a document which states the matters listed in item 1 in the case when the designated seeds were collected, the matters listed in item 2 in the case when the report was ordered, and the matters listed in item 3 in the case when the submission of documents was ordered.

Article 28. Among the authority of the Minister of Agriculture, Forestry and Fisheries under the provisions of Article 59, paragraph 4 and Article 61, paragraph 2 of the Act, the authority concerning seed dealers (excluding those providing business offices within the limits of of only one prefectural government to sell the propagating materials of rice, barley, rye, wheat, and soybeans) under Artcile 2, paragraph 6 of the Act to provide business offices within the jurisdiction of only one Regional Agricultural Administration Office in order to sell the propagating material shall be delegated to the Director general of the Regional Agricultural Administration Office. However, this does not preclude the Minister of Agriculture, Forestry, and Fisheries from performing the authority on his/her own.
2. The authority of the Minister of Agriculture, Forestry and Fisheries (excluding the authority concerning seed dealers under Article 2, paragraph 6 of the Act providing business offices within the limits of only one prefectural government in order to sell the propagating materials of rice, barley, rye, wheat, and soybeans) under the provisions of Article 62 and Article 65 of the Act shall be delegated to the Director general of the Regional Agricultural Administration Office. However, this does not preclude the Minister of Agriculture, Forestry, and Fisheries from performing the authority on his/her own.
